LHC suspends final determination order over anti-dumping duty on peti

LAHORE: A single bench headed by Justice Atir Mahood of Lahore High Court, Lahore Judicial Department subject to notice for the said dated and submission of personal surety bond y the proprietor/ appellant against the disputed anti-dumping Duty, the impugned final determination dated June 13, 2018 is suspended till the next date of hearing on a constitutional petition filed by M/s Sama Trade.

While the hearing of the case, the court also issued notices to the customs authorities for Feb 03, 2020 and directed them to file their respective para wise comments for the next date of hearing.

During the hearing, Naveed Zafar Khan, advocate for the appellant appears before the court and argues that identical matters in this case have already been entertained by this court and notices have been issued to the respondents therein.

He further argues that the authorities below misdirected themselves regarding the law as well as facts while upholding the proceedings as the prices publicized by domestic industry were insufficient and in any related to a single company.

After the hearing, court issued notices to the customs authorities and passed an order on an application that subject to notice for the said dated and submission of personal surety bond y the proprietor/ appellant against the disputed anti-dumping Duty, the impugned final determination dated June 13, 2018 is suspended till the next date of hearing.

Petitioner cited Anti-Dumping Appellate Tribunal, National Tariff Commission, International Steel Limited as respondents.
