M/s Dany Technologies moves SHC against detention of its imported consignments of mobile accessories

KARACHI: M/s Dany Technologies has approached The Sindh High Court (SHC) and filed a constitutional petition against detention of its imported consignments of mobile accessories of low-end brand assorted brands including computer data cable, earphone unpacked form, mobile speaker, multimedia tower speaker 2.0 MP3 mini remote etc seized by customs department.

On 21 January 2021, counsel for the petitioner stated that the petitioner is a regular importer of mobile accessories from various countries including China and imported consignments of mobile accessories of low-end brand assorted brands including computer data cable, earphone unpacked form, mobile speaker, multimedia tower speaker 2.0 MP3 mini remote filed goods declaration dated Jan 11, 2021.

He further submitted that petitioner being aggrieved and prejudiced by the illegal and mala fide action of valuation department, whereby the valuation ruling bearing no 1462/2020 dated Aug 11, 2020 was issued whereby value of mobile accessories unilaterally enhanced and fixed at exorbitant values.

Counsel stated that through this petition, petitioner is seeking the intervention of this court in the matter where respondent deny provisional release of consignment of mobile accessories, while petitioner first statutory appeal filed against the impugned order-in-revision no 33/ 202 dated Oct 21, 2020 is pending before the appellate forum and matter is likely to take some time as the appellate tribunal is not functional.

Counsel further argued that petitioner will suffer irreparable loss if petitioner consignments are not released during pendency of the petitioner.

Citing chairman FBR, chief collector of Customs Southern, DG Valuation ruling as respondents, petitioner pleaded the court to declare that denial to allow provisional release notwithstanding the directions as per this court dated Sep 22, 2020 is unlawful and tantamount to contempt of court.
