M/s Khyber Traders moves SHC against enhancement of valuation of body spray consignment

KARACHI: M/s Khyber Traders has approached the Sindh High Court (SHC) and filed a constitutional petition against enhancement of valuation of imported consignment of body spray 150ml, EDT 1ml & advertisement material.

On 5 April 2021, counsel for the petitioner stated that in the normal course of business, the petitioner is being active importer, exporter wholesaler & distributors company, the petitioner imported the consignment of body spray 150ml, EDT 1ml & advertisement material and filed goods declaration according with law.

He submitted that petitioner was shocked when he was informed that customs officials refused to accept its goods declaration for clearance on declared value, neither consider the mutual agreement, nor consider the bank transaction and assess the imported goods on the basis of irrelevant valuation data/ expire valuation ruling no 1456/ 2020 without any cogent evidence/ specific reasons, without consider the subject goods are imported against the contract agreement as well as bank transaction, neither there any proof regarding evidence of invoice value/ transactional value nor is any valid valuation ruling of the directorate general of valuation available with the customs department leading to increase in duty and taxes, therefore, enhance duty and taxes, it is illegal and against the law valuation committee direction or fresh notification issued by the collectorate, the assessment officer enhance the value without justification and cogent reason, therefore, demanded enhance duty and taxes, it is illegal and against the law.

Citing chairman FBR, collector of Customs Appraisement Port Muhammad Bin Qasim and director valuation, Directorate General of Customs Valuation as respondents, petitioner pleaded the court may declare that impugned assessment is unlawful, without lawful authority.

He further pleaded the court to grant such relief or release which the court may deem fit and proper under the circumstances of the case; it is
