Customs PMBQ submits comments on petition filed by M/s Radium Silk Factory

KARACHI:  Collectorate of Customs Appraisement Port Muhammad Bin Qasim (PMBQ) has submitted comments before a division bench of the Sindh High Court (SHC) and requested the court for dismissal of petition filed by M/s Radium Silk Factory against detention of its imported consignment.

On 10 September 2021, a two-member bench, headed by Justice Shafi Muhammad Siddiqui and Justice Agha Faisal heard the matter.

During the hearing, Rana Sakhawat Ali appeared on behalf of the petitioner, Dr Shah Nawaz Advocate and Khalid Rajpar appeared on behalf of the customs officials, during the hearing, counsel for the Collectorate of Customs Appraisement Port Muhammad Bin Qasim submitted his para wise comments and argued that petition is not maintainable, therefore, court may dismiss the petition.

After the hearing, court directed other respondents to submit their respective para wise comments and also directed counsel for the petitioner to submit his rejoinder for next date of hearing.

Earlier, counsel had argued that petitioner had imported consignments comprising polyester yarn on unit value of US$ 1.30 per kg and filed goods declaration according with law, however, petitioner is seriously aggrieved and highly prejudiced by the actions of the respondents, whereby the respondents have denied to accept the declared value of the imported consignments and are assessing the duty and taxes on the basis of the valuation ruling no 1338/2018 dated Oct 25, 2018 issued by the DG Valuation, despite the fact the impugned valuation ruling is not sustainable in the eyes of the law.

Citing chairman Federal Board of Revenue, Collector of Customs Appraisement East, Collector of Customs Appraisement West, director, Directorate General of Customs Valuation as respondents, counsel pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
