SHC dismisses SCRA filed by Collector Preventive against M/s A. R & Company

KARACHI: The Sindh High Court (SHC) has dismissed Special Customs Reference Application (SCRA) filed by collector of customs preventive challenging impugned order passed by appellant tribunal set aside a show cause notice which was issued to importer.

On 30 September 2021, a two-member bench of the Sindh High Court, comprising Justice Shafi Muhammad Siddiqui and Justice Agha Faisal heard the matter.

After the hearing, court dismissed Special Customs Reference Application along with listed applications.

Counsel for the customs department had argued in the special customs reference application that M/s A. R & Company Diplomatic Bonded Warehouse Karachi had violated customs laws and therefore, a show cause notice was issued to said company and customs department called explanation from the M/s A. R & Company.

Customs officials added in SCRA that said respondent being aggrieved from show cause notice, approached customs appellant tribunal in which customs appellant tribunal allowed respondent appeal and set aside impugned show cause notice.

Citing M/s A. R & Company Diplomatic Bonded Warehouse Karachi and customs appellant as respondents, applicant pleaded the court may declare that customs appellant has overlook the ground reality and misinterpreted customs laws and illegally set aside impugned show cause notice.

Applicant also pleaded the court may set aside impugned order passed by customs appellant tribunal and restore show cause notice issued by the applicant.
