SHC seeks reply on petition filed by Stafford Miller (Ireland) Ltd & Block Drug Company Inc

KARACHI: The Sindh High Court (SHC) directed customs officials to submit their respective para wise comments on a constitutional petition filed by Stafford Miller (Ireland) Ltd, Block Drug Company Inc against reopening the old case.

On 18 December 2021, a two-member bench, headed by Justice Shafi Muhammad Siddiqui heard the matter.

During the hearing, counsel for the petitioner argues that the being aggrieved of FBR’s purported order dated April 27, 2021 for a direction to reopen the case and the subsequent orders passed by collector of customs adjudication, including show cause notice dated April 29, 2021 and the alleged order dated May 04, 2021 for release of counterfeit Sensodyne goods.

Citing Chairman Federal Board of Revenue, Directorate IPR Enforcement, Directorate General Afghan Transit Trade and Collector of Customs Appraisement West as respondents, petitioner pleaded the court may allow the petition and order dated April 29, 2021 may kindly be set aside, as a sequential relief.

He further pleaded the court, the show cause notice dated April 29, 2021 issued by collector of customs adjudication  as well as the order for release of the counterfeit goods, may be set aside and direction be issued to the concerned quarters to initiate appropriate departmental proceedings against Muhammad Amir Thahim Collector of Customs Adjudication-I for abuse of authority, transgression of law and collusion.
