M/s Aisha Corporation moves SHC seeking release order for detained consignment

KARACHI: A two-member bench of the Sindh High Court (SHC) issued notices to the customs department and deputy attorney general of Pakistan on a constitutional petition filed by M/s Aisha Corporation seeking release order for imported consignment of canned tropical Fruit Cocktail & Pine Apple Slices.

On 28 February 2022, during the hearing, counsel for the petitioner argued that petitioner had imported a consignment of Canned Tropical Fruit Cocktail & Pine Apple Slices and filed goods declaration according with law and after fulfilment of all legal formalities, petitioner approached the customs officials for release order.

He further informed the court that however, petitioner was shocked, when he was informed that above mentioned consignment has been hold due to disputed valuation under the garb of valuation ruling no 1590/2022 dated Jan 18, 2022.

Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector of Customs Port Muhammad Bin Qasim, Collector of Customs Appraisement West as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

Petitioner further pleaded the court to direct them to release petitioner’s imported goods as well as restrain them from taking any adverse action against the petitioner till final order in this petition.
