KARACHI: A two-member bench of the Sindh High Court (SHC), headed by justice Irfan Sadat Khan granted urgency and fixed March 8, 2022 as date of hearing of a constitutional petition filed by M/s Dollar Industries Private Limited seeking release order for imported black lead pencils and color pencils etc.
It needs to be mentioned here, on last date of hearing, court has directed customs officials to release above-mentioned goods on provisional release after securing differential amounts on the shape of bank guarantee or pay order.
During the hearing, Salahuddin Ahmed advocate appeared before the court on behalf of the petitioner and moved urgent application, he argued that matter is urgent basis, therefore, court may grant his urgency and fixed nearest date of hearing.
After the hearing, court granted urgent application and fixed March 08, 2022 as a date of hearing, court also issued notices the respondents and asked them to file their respective para wise comments for next date of hearing.
Earlier, counsel for the petitioner argued in his constitutional petition that, during the course of business, petitioner imported above mentioned goods and after fulfilment of all legal formalities, filed goods declarations according to law.
He states that however, petitioner was informed that customs officials fixed higher valuation under the garb of valuation ruling no 1598/2022 dated Feb 04, 2022 which is high than petitioner’s claiming valuations.
Citing Chairman Federal Board of Revenue, Director General Valuation, Collector of Customs Appraisement West, Collector of Customs Appraisement East and others, petitioner pleaded the court to declare that act of the respondents is unlawful, mala fide and arbitrary.
He also pleaded the court may set aside impugned show cause notice and directed them to release the same as well as restrain them from taking any adverse action against the petitioner till final order in this constitutional petition.
