SHC seeks comments on petition filed by M/s Al Asar Enterprises

KARACHI: The Sindh High Court (SHC) issued notices to the customs department and deputy attorney general directing them to file their respective para wise comments on a constitutional petition filed by M/s Al Asar Enterprises seeking release order for imported gloves.

Dated March 18, 2022, during the hearing, Sardar Faisal Advocate appeared behalf of the petitioner and argued that demand notice without process of adjudication has been issued and on the face of it is illegal.

During the hearing, counsel argued that during the course of its business, petitioner imported cloves (1080 CTNS) vide H. S Code 0907.1000 and goods declaration vide # KAPE-HC-119490-21-4-2020 same assessed as per declaration an description vide payment of duty and taxes.

He states that after the formalities, petitioner filed goods declaration according to law, however, petitioner was shocked when it was informed that valuation of unit price was changed from US$ 4 to 5, meaning thereby an additional demand of in differential of duty and takes to be paid.

Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector of Customs Appraisement East as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

He further pleaded the court may set aside impugned demand and enhancement of valuation as well as restrain them from taking any adverse action against the petitioner till final order in this petition.
