SHC directs to release consignment imported by M/s Pakistan Decorative Materials Private Limited on bank guarantee

KARACHI: The Sindh High Court (SHC) directed customs officials to release the imported goods after securing differential amounts on the shape of bank guarantee/ pay order on a constitutional petition filed by M/s Pakistan Decorative Materials (SMC-Pvt) Ltd.

On 29 March  2022, a two-member bench, headed by Justice Irfan Sadat Khan heard the matter.

During the hearing, Fauzia Rasheed Advocate for petitioner, Kafeel Ahmed Abbasi, deputy attorney general of Pakistan appeared before the court, counsel for the petitioner moved urgent application which was allowed by the court.

After the hearing, court passed an order and observed that “this is the case of the petitioner that valuation ruling has been challenged before the director general valuation and hence they seek release of the consignment on payment of duties and taxes on the declared value and secure the differential amount of the valuation ruling.

Presently under challenged, by depositing the same with the Collectorate/ department by way of pay orders/ bank guarantee on securing the differential amount with the Collectorate/ department as above in concerned deputy attorney general, who is present in court has waived notice and has no objection to release the consignment of the petitioner.

Let the goods be released in terms of the above observation leaving and department at liberty to act in according with law. Petition stands disposed of along with pending applications.

Citing Chairman Federal Board of Revenue, Collector of Customs Appraisement East, Director General Valuation as respondents, petitioner pleaded the court to direct them to release the imported aluminum composite panel according to law.

Petitioner further pleaded the court to set aside impugned valuation ruling no 1610/ 2022 and restrain them from taking any adverse action against the petitioner till final order in this case.
