SHC seeks comments from customs officials on petition filed by M/s Mian Shafiq Business International

KARACHI: A two-member bench of The Sind High Court (SHC) directed customs officials to file their respective para wise comments for next date of hearing on a constitutional petition filed by M/s Mian Shafiq Business International seeking release order for imported tyres and tubes with flaps of various sizes.

On 9 April 2022, during the hearing, Ghulam Hyder Shaikh advocate on behalf of the petitioner and Khalil Dogar appeared for customs department.

During the hearing, counsel for the petitioner has argued that petitioner is doing lawful import, whole sale and retail trade of tyres and tubes of various categories, specifications, seized and dumpers, constructions & mining machinery, wheel loading, concrete mixers & international handling vehicles etc.

Counsel added that during business, petitioner has imported a number of consignments assorted tyres and tubes with flaps of various seized and filed goods declarations according to law, however, petitioner was shocked when it was informed that above mentioned goods have been seized due to disputed valuation.

Citing Secretary Revenue Division, Chairman Federal Board of Revenue, Chief Collector of Customs South, Collectorate of Customs Appraisement West, Collector of Customs Appraisement East and others, petitioner pleaded the court may declare that act of the respondent is illegal, mala fide and arbitrary.

Counsel further pleaded the court may direct them to release petitioner’s consignment according to law and allow ex-bonding/ release the present and future consignments of the petitioner claimed PCT Heading and restrain them from taking any adverse action against the petitioner till final order in this petition.
