Illegal import of 119 vehicles: Appraisement (West) submits reply

KARACHI: The Model Customs Collectorate of Appraisement (West) has submitted a written reply and requisite documents asked by the Secretary Customs Tariff-III, Federal Board of Revenue (FBR) in connection with the illegal import of 119 vehicles under amnesty scheme.

The sources informed Customs Today that Additional Collector Fayyaz Rasool, on the directives of Collector MCC-Appraisement (West) Muhammad Saleem, provided required documents asked by the Secretary Customs Tariff-III, FBR.

It is pertinent to mention here that the Secretary Customs Tariff-III through a letter has asked the officers concerned of Pakistan Customs Services (PCS) to submit written reply against the impugned charge sheet C 9 (2) /2014-M.I in connection with the illegal import of 119 vehicles under amnesty scheme.

The FBR authorities concerned requested for the provision of the attested photocopies of the following documents in first instance.

The documents included notifications/SROs, instructions, guidelines issued by the Board for the implementation of the Scheme for Regularisation of smuggled vehicles, 2013 (Scheme) along with dates of their receipt in the Collectorate; public notice, standing order, office order or any other correspondence issued by the Collectorate specifying a procedure/SOP for the scheme; office order/correspondence issued by the Collectorate/Board indicating the job description of the undersigned under the scheme; photocopies of 119 files (containing both note sheet and correspondence sides) mentioned in para B of the charge sheet.

They also asked for documentary evidence that 119 vehicles were in the holding areas of Dubai, Sharjah, Afghanistan and auction houses in Japan during the scheme, as mentioned in the Charge Sheet, duly verified by the relevant authorities; Office Order issued by the then Collector dated 22-03-2013; SOP issued by MCC-Peshawar along with the Board’s letter through which it was circulated and its date of receipt in the Collectorate; Intelligence alerts issued by the Directorate General (I&I) dated 29-03-13 and 01-04-13 along with the dates of their receipt in the Collectorate and the correspondence by the Chief Collector (South) on the issue with the Board; Instruction, guidelines issued by the Board regarding non-presentation of vehicles as mentioned at para (xi) (a) of the Charge Sheet and the date of its receipt in the Collectorate; SOP, Office Order indicating the undersigned’s responsibility for the acts and deeds of the sub-ordinate staff as mentioned in para C of the Charge Sheet; investigation and or fact finding report, if any, conducted on the issue by FBR or any other agency and any other document deemed appropriate in connection with the subject inquiry.

The Board also asked the officers concerned for supplying of the said documents sought in the line with the verdict of the Supreme Court of Pakistan, adding that in this behalf, para 10 of the judgment reported as 1996 SCMR 201 is relied upon.
