M/s D & D Logistics moves SHC seeking release order for detained HSD, oil tanker

KARACHI: M/s D & D Logistics Private Limited has approached the Sindh High Court (SHC) and filed a constitutional petition seeking release order for 50,000-liters diesel along with Hino oil tanker which was detained four year ago.

On 6 April 2021, counsel for the petitioner stated that staff of Customs Preventive Karachi intercepted a Hino oil tanker bearing registration number TLH-463, the driver of the vehicle was asked to produce legal documents of the possession of the goods, diver produced all the legal documents, however, customs officials arrested him and goods along with vehicle were detained illegally.

He submitted that petitioner claimed ownership of the goods and informed the seizing agency that the detained tank lorry was filled from M/s Byco Refinery dated Oct 11, 2016 and the goods were in their legal possession and petitioner has all the legal documents, however, customs officials lodged the first information report against the petitioner without lawful authority.

He further submitted that the customs tribunal directed customs officials to release the same, however, customs officials are not complying the order of the customs tribunal.

Citing Collector of Customs Preventive , Additional Collector of Customs Adjudication-I and M/s Byco Petroleum Pakistan Karachi as respondents, petitioner pleaded the court to direct the respondents to release the consignments in question dated Oct 11, 2015 showing delivery of 50,000 liter of diesel as well as Hino Oil Tanker bearing registration no TKH-463.

He further pleaded the court may direct them to place before this court the quantity and status of the consignments as well as Hino Oil Tanker as above as due to lapse of about 4 years the status of both with the official respondents are questionable if so same is the responsibility of the official respondents.
