LAHORE: The Lahore High Court (LHC) set aside the Elevated Express Way project and a notification issued for land acquisition under section 17 (4) of the Land Acquisition Act, 1894. The Environment Protection Department was against the construction of the project.
The Punjab government has failed to establish the urgency reasons behind the project under which the land was being acquired from the residents of the area to build ‘Elevated Express Way’.
The bench headed by Justice Syed Mansoor Ali Shah along with other members including Justice Amin-Ud-Din Khan and Justice Shams Mehmood Mirza heard the appeals filed against the construction of elevated express way from Gulberg through Shadman, LOS and Samnabad to build Motorway II.
Justice Shah held that the court would issue guidelines for the government to follow before launching a development project.
