Customs Appellate Tribunal remands back appeal in imported used Laptop case

LAHORE: Customs Appellate Tribunal has remanded back the appeal in seized used Laptop in appeal filed by the M/s 3G Asset Management against Collector of Customs (Preventive) Customs House Lahore and others.

Muhammad Shabbir Gujjar, member Judicial bench-I heard the stance of learned counsels of appellant and respondents and passed the judgement with remarks that appellant has not provided the sufficient opportunities of hearing, therefore, the impugned order is set aside and appeal is remanded back to the collector of Customs (Appeals) to decide the case afresh to provide the sufficient opportunity of hearing to both parties.

Tribunal member also directed to decided the same case within 45 days after receipt of orders.

As per brief history of case, M/s 3G Asset Management was imported a consignment with decleard description of used laptop. The imorter was filed goods declaration number LPAF-HC-3385 for clearance . duties and taxes were paid to the tune of Rs28961.

At the time of invoice chacking customs staff founded some irrigularities and orders to importer to pay Rs76209 which is short paid by him.

After show cause notice, adjudication proceeding were culminated and order in original was passed with remarks against the importer who aggrieved with the order and filed the case before the Customs Appellate Tribunal that order in original not sustainable in the eye of law and liable to set aside on the other side respondent department argued and show willing to remands back the appeal.
