Customs tribunal sends case back to adjudication for further consideration

LAHORE: Customs Appellate Tribunal has sent appeals back to Customs Adjudication with directions to pass fresh speaking order and receive evidence which were produced by the appellant.

As per details, Rafiq and Mamoon Enterprises register appeal in the tribunal regarding the confiscation of its consignment against additional collector of Customs Adjudication Lahore, director of Directorate of Intelligence and Investigation Lahore and collector of customs Lahore.

Custom intelligence had seized the shipment, besides impounding a trailers having Registration No. SLB-2808 being used for transporting the consignment near Thokar Niaz Baig Lahore as the driver, Barkat Ali could not produce any document pertaining to legal import of the items.

After making a seizure report, the case was forward to adjudication for hearing where the judge decided the case in favour of customs and imposed charges of violation of Section 32 (1) of Customs Act, 1969 on the accused, Rafiq and Mamnoon Enterprises. The adjudication also ordered the accused to pay duty/taxes amounting to Rs 2.1 million and imposed a penalty of Rs 50,000.

Later, the appellant moved the tribunal against the decision using legal right where the member sent back the case to Customs Adjudication to explore it more on the basis of evidence being provided by appellant.
