Dy Commissioner-IR removed from service over misconduct

ISLAMABAD: The competent authority of Federal Board of Revenue has imposed major penalty of ‘removal from service’ on Syed Salahuddin Gillani, an Inland Revenue Service officer of BS-18, for misconduct with immediate effect.

The authority imposed the major penalty on the officer, presently posted as Deputy Commissioner-IR, RTO, Quetta, under under Rule 4(1) (b)(iii) of the Government Servants (E&D) Rules, 1973.

As per details, Syed Salahuddin Gillani was granted 365 days leave ex-Pakistan (LHP) from 26-09-2011 to 25-09-2012 to undertake Graduate Diploma in Finance from INTO Queens University, Belfast. After availing 212 days leave, the officer assumed duty on 26-04-2012 and applied for cancellation of unavailed leave of 153 days leave ex-Pakistan vide letter dated 01-08-2012.

The officer was asked to submit a copy of his diploma in order to process the case vide Board’s letter dated 05-09-2012. In response, the accused officer informed that he could not obtain the diploma due to family emergency vide letter dated 29-05-2013. His stance was rejected by the Board and he was directed to submit admission documents and other relevant details, in this regard.

Despite repeated directions from the Board, Gillani failed to provide the copies of his admission letters, payment of admission fee, copies of passport and other relevant details. As a final resort, letters were issued to the Directorate General (Immigration and Passports), Islamabad and Federal Investigation Agency respectively with the request to provide details of passports and foreign travels undertaken by the accused officer. In response, information from the Directorate General (Immigration and Passports) vide letter dated 25-03-2014 revealed that Gillani had been issued two passports (one expired and one active) which were acquired by him by misquoting his profession as “Business Owner”. As per record, no NOC/permission/approval was obtained by him from the Board before applying for these passports.

The FIA revealed that the officer undertook 12 foreign visits (including departure and arrival) at different points of time, without seeking NOC/permission/approval from the Board. In the light of the aforementioned information received from the said Agencies, charge sheet and statement of allegations were issued and Dr Tariq Masood (IRS/BS-20) was appointed as inquiry officer who conducted the inquiry and furnished his inquiry report on 02-04-2015, concluding that all the charges levelled against the accused officer stand established.

The Secretary Revenue Division/Chairman FBR being the Authority in this case, afforded an opportunity of being heard to the accused officer on 24-06-2015. After having considered all the aspects, material relating to the case, recommendation of the Authorized Officer/Member (Admn) and verbal submission of the accused officer held him guilty of the charge of “Misconduct” and has imposed the Major Penalty of “Removal from Service” under Rule 4(1) (b)(iii) of the Government Servants (E&D) Rules, 1973 upon Syed Salahuddin Gillani (IRS/BS-18), with immediate effect.

However, Syed Salahuddin Gilani will have a right to appeal to the Appellate Authority as provided under the relevant Rules.
