Customs reference: Sindh High Court issues notice to importer

KARACHI: The Sindh High Court has issued a notice to an importer on a special customs reference challenging the verdict of the Customs Appellate Tribunal in a case of mis-declaration.

The Collector of Customs MCC of Appraisement challenged the tribunal’s judgment that remitted a fine imposed on importer M/s Ramzan Sewing Machine and Silk Yarn for evading duty and taxes estimated at Rs 471759 by mis-declaring the value of goods.

The importer had imported a consignment of four units of embroidery machines and two units of laser cut machines from China. The value of the goods weighing 19630 kilograms was mis-declared, depriving the national exchequer the revenue of Rs 471759.

Subsequently, the contravention was prepared against the importer for evading duty and taxes and the case was referred to the Customs Adjudication. It ordered confiscation of the goods and asked the importer to pay Rs 1976504 in fine to redeem the goods. Rs 25000 penalty was also imposed on it.

The importer challenged the ONO before the collector of Collectorate of Customs (Appeals), however, its appeal was rejected. Afterwards, it moved the Customs Appellate Tribunal that remitted the fine imposed on it.
