Customs appellate tribunal disposes of case of Ilyas Rafique

LAHORE: Customs appellate tribunal has disposed of the case of Ilyas Rafique versus Additional Director Intelligence and Investigation (I and I) Multan.

Chairman Customs appellate tribunal ordered to modify impugned order and release impugned goods on the payment of taxes and duties as per assessed by the respondent department.

According to the details, the appellant Rafique Ilyas has filed the case in customs appellate tribunal and challenged the impugned order passed by the adjudication authority.

The counsel of appellant argued before the member judicial bench-I that impugned order passed by the adjudication authority has not in mechanical fashion and without proper application of law.

He added that the allegation by the respondent department that Ilyas Rafiqui has smuggled some items and the impugned goods not fall under the provision of section 2(s) of the customs act 1969.

The brief fact of case is that a truck No. Tkb 439 ON 28-08-2014 was intercepted and was impounded loaded with Iranian plastic Crush.

Ilyas rafique appeared before the adjudication authority and after finding the adjudication authority has charged 1,11,881 in tax.

Finally Customs appellate tribunal heard the case and ordered to department that release the goods on the payment of taxes and duties.
