FBR files petition in IHC to retake Ayyan’s passport

ISLAMABAD: The Federal Board of Revenue (FBR), through the customs department, has challenged the special judge’s order allowing suspect of money laundering and smuggling, Ayan Ali, to take back her passport.

Additional Collector Model Customs Collectorate, Islamabad, Abdul Waheed Marwat, filed a petition in Islamabad High Court (IHC) seeking the court to set aside the order given by special judge, customs and taxation, Rawalpindi/Islamabad. The special judge had allowed Ayyan Ali to collect her passport from the custody of Customs Department.

The petitioner prayed the court to set aside the impugned order with the consequential relief, for the sake of justice and equity.

Through the petition, the customs department submitted that order passed by special judge, customs and taxation, Rawalpindi/Islamabad was impinged as it was given despite the fact that charge, under Criminal Procedure Code, 1898, had been framed against Ayyan and the trial was expected to completed soon as it included witnesses who were government servants.

The department further stated that the order was given without jurisdiction and lawful authority. The order was a result of non-reading and mis-reading of record, the petitioner added.

It was also mentioned that the respondent (Ayyan Ali)  was alleged of offences of money laundering and smuggling and the application was pending before the adjudication.
