ISLAMABAD: The Islamabad High Court (IHC) will hear three identical tax references carrying tax claims of Rs 20.99 million on Thursday (today).
A single bench of the IHC comprising Justice Aamer Farooq would hear the cases filed by three different appellants. All three appellants had filed petitions against Regional Tax Office (RTO) and Appellate Tribunal Inland Revenue (ATIR).
M/s Khursheed Printers (Private) Limited, Hair Transplant Institute (Private) Limited and M/s Lotia Sona (Private) Limited had filed “stay petitions” fearing RTO move aiming at recovering taxes amounting to Rs 12.383 million, Rs 8.09 million and Rs 0.517 million, respectively.
The above mentioned companies had their pending cases before the ATIR-which had not yet been decided despite lapse of years since 2012.
The petitioner had prayed: “It is therefore prayed that an appropriate writ may graciously be issued, directing FBR field office (RTO) not to issue any recovery notice under section 48, and also restraining them to continue the intended recovery proceedings under reference for the tax periods July 2012 to June 2013, stop the recovery proceedings till the decision of appeal by ATIR be further directed to fix the appeal out of turn and decide the same as per law or grant any other relief is fit to compensation the petitioner”.
