Customs Appellate Tribunal declares seizure of ceremic tiles as legal

LAHORE: The Customs Appellate Tribunal had declared the seizure of ceramic tiles as legal and decided the case in favor of the Customs adjudication.

The case was filed by the departments on brief facts, as reported in Order-in-Original that the staff of Customs (ASO) Lahore intercepted a Suzuki bearing registration No.LET-1682 which found loaded with ceramics tiles. During the examination, the driver told that the tiles were loaded from the premises of M/s AR Chudhary Industries where the huge quantity of ceramic tiles were stored.

The staff of ASO Customs visited the said godown and recovered Irani origin tiles, on demand the owner of said godown failed to produce any legal documents regarding lawful possession of recovered goods. Consequently ASO forwarded the case to customs adjudication for further proceedings. Notice were issued to M/s Chaudhary Industries Limited Ferozpur Road to pursue the case.

Customs Appellate Tribunal declared that the impugned goods were smuggled into the country without payment of duty and taxes. The respondent has failed to produce any legal document about legal possession of seized goods.
