SHC directs IR commissioner to file reply in M/s OPAL case

KARACHI: The Sindh High Court on Monday once again issued notices to Karachi Regional Tax Office-II (RTO-II) Inland Revenue Zone-1 commissioner and additional commissioner directing them to file their comments in the application of M/S OPAL-25 seeking a stay order against IR commissioner’s order.

SHC judge, Justice Munib Akhter also ordered that the matter of interim relief will be taken up on next date on the basis of record as available, if the comments were not filed on next date of hearing.

Earlier, petitioner submitted that the company was registered as association of persons (AOP) firm and is engaged in a business of construction and market of land/ building as contractors in joint venture project M/S Bahria Town (PVT) Ltd and M/S Zardari Group (PVT) Ltd.

The petitioner stated that the additional commissioner passed order under Section 122 (54) of the income tax ordinance, 2001 for income tax year 2014 without appreciating the facts and wrongly made addition on account of receipt from members.

According to petitioner, its project was under construction and no sale was made during this year, therefore no income and expenses were reported in the project. The petitioner had appealed along with stay order before the commissioner but the appeal was rejected without appreciating the facts of the case.

The court was requested to set aside the order of IR commissioner.
