IR Tribunal directed to decide M/s Redtone’s case within 60 days

ISLAMABAD: The Islamabad High Court (IHC) has restrained the chief commissioner of Large Taxpayers’ Unit, Islamabad, from recovering the outstanding taxes of Rs 30,716,353 from M/S Redtone Telecommunication Pakistan (Private) Limited.

A single bench of the IHC comprising Justice Aamer Farooq heard the case and disposed it of with direction to the LTU officers and the ATIR to decide the fate of the company’s appeal within 60 days.

The appellant had challenged the LTU’s order, creating demand for Rs 30,716,353 from the appellant under the head of different duties and taxes. The order was issued under provisions of the Sales Act 1990.

Federal Board of Revenue (FBR), Deputy Commissioner Inland Revenue Large Taxpayers Unit, Islamabad, Commissioner (Appeals) and ATIR were made respondents in the case.

Earlier, LTU had rejected appellant’s departmental plea in 2015. The appellant had submitted in the court that the order was issued in violation of articles 4, 8, 10A, 18, 23, 25 and 77 of Constitution of Pakistan and tax provisions of Sales Tax Act.
