Director Yaqoob Mako advises to review valuation ruling No 786/2016

KARACHI: The Director Intelligence and Investigation, (Customs-Enforcement) Muhammad Yaqoob Mako has advised the Collectorate Appraisement-West to send reference to the Directorate General of Customs Valuation for incorporation of ‘tale master batches’ also in the valuation ruling.

The Directorate General of  Intelligence and Investigation, (Customs-Enforcement) has been observing that the Valuation Ruling 786/2016 dated 01.01.2016, related to ‘tale master batches’ is not covering the whole items’ descriptions as the  valuation ruling presently covers only colour master batches and no ruling is available for neutral tale master batches.

In this regard, the Director Intelligence and Investigation, (Customs-Enforcement) Muhammad Yaqoob Mako wrote a letter to the Collectorate Appraisement-West advising  ‘Collectorate may send reference to the DG Customs valuation for incorporation of tale master batches also in the Valuation Ruling 786/2016 dated 01.01.2016 which presently covers only colour master batches’.

As per details, the Directorate General of Intelligence and Investigation, (Customs-Enforcement), during January 2016 sealed a consignment of tale master batch imported by M/s Symbol Industries (private) Limited cleared vide GD no KAPW-HC 132586 on account of non application of relevant valuation ruling 786/2016 dated 01.010216 whereby assessable value @ $ 2.65/kg was fixed whereas the consignment was released by the Collectorate through yellow channel as the declared value of $ 1.7/kg..

On submission of seizure report the case was adjudicated by the Deputy Collector of Custom Adjudication vide order in original 487/2015-16 dated 23.02.2016 whereby redemption of fine amounting to the tune of around Rs 2 million each on importer  and clearing agents. However the clearing agent and the importer filed an appeal against the ONO before the Collector of Customs (Appeals) who has set a side the redemption fine and penalty imposed on the importers and clearing agents vide the impugned ONO on the grounds that there has been no mis-declaration in the instant impact and the goods are found as declared and the importers have submitted pay orders for the principal amount which was short levied.

In keeping view above stated case, the Directorate General of Intelligence and Investigation, (Customs-Enforcement), wrote to Collectorate Appraisement-West that the Collectorate may send reference to the DG Customs valuation for incorporation of tale master batches also in the Valuation Ruling 786/2016 dated 01.01.2016.
