SHC seeks comments on plea filed against suspension of sales tax registration

KARACHI: The Sindh High Court sought comments from Commissioner (Inland Revenue) RTO-II and others on an application filed by Muhammad Asgar against suspension of  sales tax registration.

The SHC division bench, comprising Justice Munib Akhter and justice Abdul Malik Gaddi was hearing the application. During the hearing, counsel for the respondent requested for some time to submit the comments.

Earlier, the petitioner’s counsel stated that petitioner is a sole proprietor of M/s Hussain Brothers is carrying business of commercial import of furniture and registered with Inland Revenue department. The petitioner discharging its liability under the law and in particular the sales tax Act, 1990 and submitted its return of income filed voluntarily for the year 2014 and also submitted latest sales tax return.

According to the petitioner, the respondents has suspended its sales tax registration, without issuing any show cause notice. The petitioner was  never selected for audit or any adjudication and due ever arose through audit or otherwise.

The importer said that now the M/s Meezan Bank Ltd issued a notice seeking attachments of all bank accounts of M/s Hussain Brothers on account of recovery of alleged government dues amounting to Rs 283,604,657.

Citing Secretary Revenue Division, the Chief Commissioner Inland Revenue, RTO-II, Commissioner Inland Revenue, Zone – IV, RTO -II and the Deputy Commissioner ( IR ) as respondents, the petitioner prayed to the SHC to restore its sales tax registration and restrain the bank authority from demanding such bank accounts details.
