SHC directs customs to settle M/S Eastern Contraction’ appeal

KARACHI: The Sindh High Court on Thursday directed the customs authorities to facilitate shifting of a consignment to CPF bonds and decide the appeal within 30 days on an application over alleged mis-declaration of old and used truck mounted crane.

A two-member bench, headed by chief justice Sajjad Ali Shah was hearing the application filed by M / S Eastern Contraction Co. During the hearing counsel for petitioner only prayed for shifting goods to CPF bonds till his pending appeal is decided.

Earlier petitioner’s counsel stated that petitioner imported a consignment said to contain units of old & used truck mounted crane and declared unit value $5500.00 per unit and filed declaration dated October 9, 2015.

According to the petitioner, during the examination, it was alleged that truck and crane have separate chassis frames, cabin and operation seat and its front and back ends of chassis of truck were found to be welded fresh and is very week. The department also alleged that it is an attempt to import old and used truck in the grab of truck mounted crane which is violation of Import and Export Control Act, 1950.

Citing Ministry of Finance secretary, Appraisement-West collector as respondents, the petitioner pleaded the SHC may declare that act of the respondents’ staff detaining the said used truck mounted crane of the petitioner, illegal, without lawful.
