IHC restrains LTU from recovering over Rs 653m from company until decision of case by ATIR

ISLAMABAD: The Islamabad High Court (IHC) on Friday directed the Large Taxpayers Unit (LTU) not to recover outstanding taxes amounting to Rs 653.652 million until the adjudication of the appellant’s appeal pending before the Appellate Tribunal Inland Revenue (ATIR).

A single bench of the IHC comprising Justice Aamer Farooq issued the said directions while hearing a case filed by M/s Pakistan Mobile Communication Limited.

The court also directed the ATIR to decide the fate of the appeal filed by appellant within 60 days and submit a report in the court.

M/s Pakistan Mobile Communication Limited had submitted a plea challenging the LTU order issued in 2014 mentioning outstanding taxes of Rs 653 million against the company on account of federal excise duty.

The appellant had challenged the ATIR decisions before the court, asking the court to restrain the FBR’s field office from recovering the outstanding taxes.

the LTU’s chief commissioner, Inland Revenue (IR) commissioner, IR-Audit commissioner, and ATIR and others were made party in the case.
