IHC directs Chief Commissioner IR to decide appeal of M/s Bami Khan Flour Mills in 45 days

ISLAMABAD: A single bench of the Islamabad High Court (IHC) has directed the Chief Commissioner Inland Revenue, Large Taxpayers’ Unit to decide the appeal challenging recovery order of outstanding tax amount of Rs 28,404,486.

A single bench of the IHC comprising Justice Aamer Farooq heard the case and disposed it of, directing the LTU to decide the appeal in 45 days.

M/s Bami Khan Flour and General Mills Private Limited had filed the petition in which it had challenged LTU order, dated, June 19, 2015, creating demand of said amount for tax year 2009, under provisions of Income Tax Ordinance, 2001.

The court had alos directed the LTU to abstain from realizing recovery of said amount till decision on the appeal filed before officer to LTU.

Federal Board of Revenue (FBR), LTU’s chief commissioner, commissioner Inland Revenue, Commissioner Inland Revenue (Audit), commissioner Inland Revenue (Enforcement) and deputy commissioner Inland Revenue were made party in the case.
