SHC seeks remarks from Commissioner IR on plea filed by Abdul Majid

KARACHIl: The Sindh High Court (SHC) on Monday sought comments from the Commissioner Inland Revenue Zone – II, Regional Tax Office II, on an application filed by Abdul Majid for the restoration of his company’s seized records.

A division bench of the SHC comprising Justice Munib Akhter and Justice Abdul Malik Gaddi heard the petition. During the hearing, the counsel for the respondents requested for some time to file para wise comments.

The court also continued interim order made earlier in which respondents were directed not to take any coercive action against the petitioner and to conduct themselves sickly in accordance with law.

Earlier, the petitioner’s counsel stated that petitioner is a importer and wholesaler of motor vehicle tyres etc associated with the name of style M/s Shaikh Brothers and regularly discharging his tax liabilities.

According to the petitioner, officials of the respondents conducted physical verification of stocks and records of his company on 13th Nov 2015 and left without any adverse remarks. However, according to the petitioner on 16th November 2015, respondents illegally and unjustified raided the premises of the Shaikh Brothers and seized the entire record without any search warrant or notice.

The counsel argued that petitioner is facing serious problems to conduct daily business due to this illegal act of respondents.

Citing Commissioner Inland Revenue, Zone – II, Regional Tax Office, II, Deputy Commissioner Inland Revenue, Zone – II and others as respondents, the petitioner pleaded the SHC to direct the respondents to restore the seized record of the company.
