SHC dismiss petition filed by Mushtaq Shaheen against auction of Toyota Coaster

KARACHI: The Sindh High Court (SHC) on Tuesday dismissed a petition filed by Muhammad Mushtaq Shaheen against auction of his imported 29-seater Toyota Coaster by customs authorities. A two-member bench headed by Chief Justice Sajjad Ali Shah heard the petition. During the hearing, the petitioner’s counsel did not press the petition; therefore the petition was dismissed.

Earlier, the petitioner’s counsel stated that petitioner imported a 29-seater Toyota Coaster and started the clearance procedure through custom clearing agent. Meanwhile, officials of the customs authorities auctioned his vehicle without issuing notice to him which is illegal unlawful.

The petitioner argued that vehicle was neither smuggled nor tampered and petitioner purchased the same with original documents which are in the shape of bill of lading.

Citing chairman FBR, collector Customs Appraisment -West KICT and others as the respondents, the counsel pleaded the SHC to declare the act of the respondents as illegal and malafide. The court was further requested to restrain respondents from handing over the said vehicle to the auction purchaser.
