IHC bench directs ATIR to decide case of Pakistan Mobile Communication within 60 days

ISLAMABAD: A single bench of the Islamabad High Court (IHC) on Monday directed the Appellate Tribunal Inland Revenue (ATIR) to decide the case of tax liability of Rs 122.8 million within 60 days

A single bench of the IHC comprising Justice Aamer Farooq disposed of the case filed by Pakistan Mobile Communication Limited and also directed the Large Taxpayers’ Unit to abstain from making recovery of the said amount until the decision on the appellant’s petition pending before the tribunal.

The company had challenged LTU demand notice, dated December 10, 2015, creating demand of Rs 122.8 million for the tax year 2010 under the head of income tax. The LTU had issued the notice under provisions of Income Tax Ordinance, 2001.

The appellant had claimed before the court that the demand notice was issued without hearing them, hence it must be declared illegal and in violation of law.

LTU officers including chief commissioner, commissioner Inland Revenue, assistant commissioner Inland Revenue and Federal Board of Revenue were made respondent in the case.
