SHC adjourns hearing of plea filed by M/s Kolachi Food until June 1

KARACHI: The Sindh High Court (SHC) on Tuesday directed the petitioner to submit a rejoinder in the next hearing of a petition filed by Kolachi Food, challenging the raid of the officials of the Commissioner IR and others at its restaurant.

A division bench of the SHC comprising Justice Munib Akhter and Justice Abdul Malik Gaddi heard the petition of the Kolachi Food owners Murtaza Raza Ladhubhai and Hussnain Raza Ladhubhai.

During the hearing, the counsel for the respondent filed their comments. However, the petitioner’s counsel requested some time for taking instructions to file a rejoinder. The court adjourned the hearing until June 1, 2016 and continued interim order until the next date.

Earlier, the petitioner’s counsel stated that on 5th April 2016 some persons who claimed to be the officials of the commissioner IR, Zone – IV, RTO and chief commissioner IR came along with two police mobiles and raided the restaurant premises of the Karachi Food situated at Do Darya, Beach Avenue, DHA and the head office of the Karachi Food situated at 610 Panarama Centre, Saddar Town.

The raiders took away laptops, computers, box files etc. The counsel argued that each and every transaction of the Karachi Food’s business is duly recorded in the cash register and its complete record is available. The petitioner added that it has been paying all the due taxes.

The counsel prayed the court to declare the act of the respondents as illegal and malafide. The court was further requested by the petitioners to restrain the respondents from taking any action against them.
