IHC direcs RTO Islamabad to decide case of M/s Rani Foods within 60 days

ISLAMABAD: Justice Aamer Farooq of Islamabad High Court directed the Regional Tax Office, Islamabad to hear and decide M/s Rani Foods Private Limited’s application within 60 days challenging demanded recovery of outstanding tax.

The bench also barred Regional Tax Office, Islamabad from recovering outstanding tax amount of Rs 586,160 from the appellant. With the said directions, the court disposed of the case.

The company had challenged RTO demand notice, dated May 5, 2016, creating demand of Rs 586,160 for the tax year 2013 in head of income tax. RTO had issued the notice under provisions of Income Tax Ordinance, 2001.

The appellant had claimed before the court that the demand notice was issued without hearing them, hence it must be declared illegal and in violation of law

RTO officers including chief commissioner, commissioner Inland Revenue, assistant commissioner Inland Revenue and Federal Board of Revenue were made respondent in the case.
