IHC bars FBR from recovering tax from IESCO

ISLAMABAD: A single bench of the Islamabad High Court (IHC) has decided the tax matter filed by Islamabad Electric Supply Company (IESCO) and restricted the Federal Board of Revenue (FBR) from recovering tax liability of around Rs 551 million from the IESCO until decision on a departmental appeal.

The court also directed the Regional Tax Office (RTO), Islamabad of the FBR to decide IESCO departmental appeal pending before the commissioner appeals within 30 days.

A single bench of the IHC comprising of Justice Aamer Farooq decided the matter in favour of the appellant who had challenged the Regional Tax Office’s order mentioning around Rs 551 million as outstanding amount from the IESCO.

The RTO had issued the notice for tax year 2015 under the head of Income Tax under provisions of Income Tax Ordinance, 2001.

In its decision, the bench had also restricted the FBR’s field office, RTO, from recovering the said amount until decision of the departmental appeal of the appellant. The appellant had made the FBR and RTO as respondents in the case.
