SHC moved against tax notice of Rs 4.1m

KARACHI: M / S Noman Traders has approached the Sindh High Court ( SHC ), challenging impugned demand notice of Rs 4.109 million and seeking release of three consignments of baby cycle parts and others miscellaneous items imported from China.

The petitioner stated that it engaged in the business of manufacturing baby cycle as well as on import of baby cycle parts and others miscellaneous items mainly from China. It added that it imported three consignments of baby cycle parts from China which comprising motorcycle decoration parts, coups of fork, spring set, food rest, value cap, motorcycle small horn, plastic pork rubber grips, plastic paddle, break level, reflector and etc and filed goods declaration on May 31, 2016 and fulfilled all requirements and liabilities.

According to the petitioner, it was informed that some amount is payable against the petitioner with respect to previously cleared consignments ,as per the information given by the officials of the customs authorities, amount of Rs 4,109,573 is recoverable from the petitioner against the said consignments.

According to the petitioner, it replied that it had imported said consignments in year 2007 and had paid the duties and taxes in accordance with the declared value and amount of Rs 1,544,190. The petitioner said that it had requested the respondents to release the consignments but they are denying release of its presently imported consignments. Importer argued that respondents have no right to demand such as amount.

Citing Revenue Division secretary, Model Customs Collectorate Port Qasim, Model Customs Collectorate Appraisement-West, East as respondent, the petitioner pleaded the SHC to declare the act of the respondents to block the imported consignments as illegal, mala fide and unjustified. The court was further requested to set aside impugned order and restrain the respondents from taking any coercive action against the petitioner.
