IHC adjourns hearing of four tax references during third week of July

ISLAMABAD: The Islamabad High Court heard around four tax references containing huge tax claims, cumulatively of Rs1,647,330,015, during third week of ongoing month of July.

Out of these four big cases, one was disposed of while hearing of three other cases was adjourned to coming months. Justice Aamer Farooq of IHC heard the cases. He disposed  of a case filed by Defence Housing Authority (DHA) and adjourned hearing of three other cases filed by M/s Pakistan Mobile Communication Limited and M/s Pakistan Telecommunication Limited.

While disposing of the Defence Housing Authority’s case, the court restricted the Large Taxpayers Unit, Islamabad from recovering outstanding tax amount of Rs1,210,253,332. The court also directed the LTU to decide the pending appeal challenging the show cause notice issued in pretext of outstanding tax amount.

The bench adjourned hearing of a tax reference filed by M/s Pakistan Mobile Communication Limited in which the company has challenged a tax recovery claim amounting to Rs122,865,125 issued by field office of Federal Board of Revenue (FBR).

M/s Pakistan Mobile Communication Limited had filed the case seeking restrictions for Large Taxpayers Unit, Islamabad about recovering outstanding tax amount of Rs122,865,125. The appellant had also sought from court to nullify the LTU order carrying the claim about outstanding tax amount.

Hearing of another case of same appellant was adjourned till the month of September in which the party had sought restrictions for Large Taxpayers Unit, Islamabad about recovering outstanding tax amount of Rs282,120,358. The appellant had also sought from court to nullify the LTU order carrying the claim about outstanding tax amount.

Fourth case was filed by M/s Pakistan Telecommunication Company Limited. It had also challenged FBR notice regarding recovery of Rs32,091,200. The appellant had also sought from court to nullify the LTU order carrying the claim about outstanding tax amount. Hearing of this case was also adjourned till September.
