SHC seeks petitioner’s comment on maintainability of petition

KARACHI: The Sindh High Court (SHC) has directed the learned counsel for the petitioner to satisfy the court about the maintainability of the petition filed by Orient Electronics (Private) Limited, seeking release order of impounded truck/trailer along with the container with 220 units of indoor and outdoor split air conditioners, which were seized by Directorate General of Customs Intelligence and Investigation.

A two-member bench, comprising Justice Iqbal Kalhoro and Justice Khadim Hussain M Sheikh heard the petition. During the hearing, the counsel for the petitioner sought time for preparation on maintainability. On the last date of hearing, the court also sought from the counsel to satisfy the court about the maintainability of the petition.

Earlier, petitioner’s counsel stated that it sold 220 units of splits air conditioners to M/s Abbas Traders at Karachi and same were being transported from Lahore to Karachi through Nissan Trailer registration no TLF-369 against a proper delivery, however, it was intercepted by officials of the respondents dated April 05, 2016.

According to the petitioner, driver produced the copy of the bills and others relevant documents. However, respondents seized the truck along with the container with 220 units of indoor and outdoor splits air conditioners illegally.

Citing FBR chairman, Model Customs Collectorate, Customs Intelligence-Anti-Smuggling as respondents, the petitioner pleaded the SHC may direct the respondents to release the truck along with 220 units of splits air conditioners.
