The counsel added that the field formation collected excessive tax from taxpayers during last three years. The petitioner approached the commissioner concerned in RTO many times for refunds but no action was taken in this regard by the RTO Sialkot.

Eventually, the appellants decided to approach Federal Tax Ombudsman (FTO) to direct the RTO Sialkot to clear the pending refund claims as early as possible, the counsel argued, adding that the RTO Sialkot should clear the refunds at the end of fiscal year but it did not do the same.

On the other side, counsel for RTO Sialkot argued that the RTO has ready to settle the case after assessment. After hearing the arguments from both sides the Adviser of Federal Tax Ombudsman Tariq Yousaf adjourned the case filed by M/s Alba Engineering, Daska till next date for further hearing and directed the parties to appear on said date.
