SHC seeks comments from tax authorities on constitutional petition

KARACHI: The Sindh High Court (SHC) sought comments from the tax authorities on a constitutional petition filed by M/s Sun Steel Industries, seeking release of the trans-shipment of the imported raw material of the petitioner to Sambrial EPZ section under 226 of customs rule 2001.

A two-member bench, comprising Justice Munib Akhter and Justice Anwar Hussain, was hearing the petition.

Earlier, the petitioner’s counsel stated that petitioner is a manufacturer and imported raw material which has been lying within the port area and custody of the collector of customs model customs collectorate and the additional collector, model customs collectorate, appraisment East since November 12, 2015.

According to the petitioner, it filed the trans-shipment goods declaration and approached the respondents for allowing trans-shipment of the said goods for Sambrial export processing zone, because the respondents had blocked the filing and processing of such goods declaration for trans-shipment in their computer system with malafide intention.

Citing Chairman Federal Board of Revenue (FBR), The chief collector of customs, customs collectorate, appraisment South, The collector of customs collectorate, appraisment-Eest and the Collector of customs collectorate, appraisment-East as respondents, Petitioner pleaded the SHC may direct the respondents to allow trans-shipment of the imported raw material of the petitioner to sambrial EPZ under 226 of customs rule 2001.
