IHC adjourns hearing of tax references filed against Customs Appellate Tribunal, FBR

ISLAMABAD: A division bench of the Islamabad High Court (IHC) on Friday adjourned the hearing of a couple of tax references involving the Federal Board of Revenue and the Customs Appellate Tribunal.

The divisional bench, comprising Justice Noor-Ul-Haq N Qureshi and Justice Athar Minallah, heard the cases and adjourned the hearing.

M/s TNB Liberty Power Limited Islamabad had filed the case, seeking restrictions for the Large Taxpayers Unit, Islamabad, from recovering outstanding tax amount or making any other coercive move prior to the court’s directions on the issue.

M/s Sun Diplomatic Bonded Warehouse Private Limited had filed the other reference challenging decision announced by the Customs Appellate Tribunal, Islamabad. The tribunal was made main respondent in the case.

M/s TNB Liberty Power Limited Islamabad also stated that show cause notice claiming mentioning outstanding tax amount was issued with mala-fide intentions. The appellant further prayed the court to bar LTU from taking coercive measure to recover the said amount.

Federal Board of Revenue (FBR), officers of LTU including Commissioner Inland Revenue and Commissioner Inland Revenue (Appeals) were made respondent in the case.
