IHC reserves verdict of couple of tax references filed against FBR in second week of Oct

ISLAMABAD: The Islamabad High Court (IHC) reserved decision of a couple of important tax references filed against the Federal Board of Revenue (FBR) during second week of October. In this regard, the first case was heard by the IHC single bench comprising Justice Miangul Hassan Aurangzeb.

Mumtaz Construction Company (Private) Limited had filed the case challenging the LTU show cause notice demanding payment of outstanding tax amount. The bench reserved the decision after hearing arguments from both sides.

Mumtaz Construction Company Private Limited had filed the cases against LTU, Islamabad and had made deputy commissioner Inland Revenue the main respondent along with ATIR.

Other case was heard by IHC division bench comprising Justice Noor ul Haq N Qureshi and Justice Athar Minallah.

Through the petition, M/S Liberty Power Limited had challenged recovery notice of Rs 9,223,769 issued by Large Taxpayers’ Unit, Islamabad. The bench reserved decision on the case which was likely to be announced in coming week.

The appellant had challenged a recovery order of Large Taxpayers’ Unit, issued in May, 2016. LTU had issued the order stating the recoverable outstanding tax amount for the tax period of 2010-2012.

Federal Board of Revenue (FBR), LTU’s commissioner Inland Revenue, deputy commissioner Inland Revenue, deputy commissioner Inland Revenue Enforcement and ATIR were made party in the case.
