IHC adjourns hearing of two cases challenging tax recovery claims till Oct 17

ISLAMABAD: The Islamabad High Court (IHC) has adjourned the hearing of cases involving tax recovery claims of Rs 4,927,413 and Rs 2,342,512 announced by the Federal Board of Revenue during second week of October.

A division bench of the IHC, comprising Justice Shaukat Aziz Siddiqui and Justice Mohsin Akhtar Kayani, heard the case filed by Ch Muhammad Asif, challenging recovery claim of Rs 4,927,413 in head of income tax. The bench adjourned hearing till October 17.

The appellant had challenged the decision announced by ATIR as well as the show cause notice issued by the RTO, Islamabad regarding the outstanding tax amount.

The appellant had submitted that the show cause notice issued to him in head of income tax was illegal and was based on mala-fide intentions.

Justice Aamer Farooq heard the other case filed by Central Power Purchasing Agency Limited. The appellant had submitted plea asking the court to restrict the Large Taxpayers Unit, Islamabad (LTU) from recovering Rs 2,342,512.

Federal Board of Revenue (FBR), officers of LTU including Commissioner Inland Revenue, and Commissioner Inland Revenue (Appeals) were made respondent in the case.

Central Power Purchasing Agency Limited prayed that the assessment order issued by the LTU officer was illegal, unlawful and without legal grounds. It also prayed the court to set aside the LTU notice and provide the appellant relief in this regard.
