SHC issues notice to tax authorities on petition filed by Kashif

KARACHI: The Sindh High Court (SHC) gas issued notices to the tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by Kashif, seeking release of his consignment of 1,421 cartons of toiletries and general goods.

While the hearing the petition, a two-member bench, comprising Justice Munib Akhtar and Saeeduddin Nasir, also directed them to file their respective comments on the next hearing.

Earlier, counsel for the petitioner stated in his constitution petition that petitioner is a sole proprietary of M/s K.T Enterprises and imported 1421 cartons of toiletries and general goods and filed goods declarations dated 05/09/2016 after the examination, petitioner was not satisfied with the examination, therefore, importer moved an application for second examination and after the second examination, petitioner had paid duties and taxes accordingly dated 29/09/2016 and approached the respondents for release his consignment.

According to the petitioner, however, he was informed by the officials of the respondents that his consignment is “hold” position. Petitioner further argued that act of the respondent’s amount to seizure of petitioner’s consignment without jurisdiction.

Citing the Chairman Federal Board of Revenue (FBR), The Collector of Customs Port Muhammad Bin Qasim Karachi and Additional Collector of Customs Port Muhammad Bin Qasim as respondents, petitioner pleaded the court may declare that action of the respondents is illegal, mala fide and unlawful.

Importer also pleaded the SHC may direct the respondents to release the consignment of the petitioner immediately and restrain them from taking any coercive action against the petitioner.
