AR Associates challenges valuation of toilet soaps

KARACHI: The Sindh High Court (SHC) has issued notices to the tax authorities and deputy attorney general of Pakistan on a petition filed by AR Associates, challenging the impugned Valuation Ruling No 863/2016, which enhanced the customs values of “toilet soaps of various brands”.

While hearing the petition, a two-member bench, comprising Justice Munib Akhtar and Justice Saeeduddin Nasir also directed them to file their respective comments on the next hearing. The court has adjourned the hearing for October 26, 2016.

Earlier, counsel for the petitioner stated that petitioner is serious aggrieved and prejudiced by the unlawful act of the respondents, whereby the director of Customs Valuation had issued the valuation ruling for toilet soaps of various brands including the brand of the petitioner “charm” and fixed/purportedly determined the increased values without adherence to the provisions of Section 25 and 25 A of the Custom Act, 1969.

Citing Federal Board of Revenue (FBR) chariman, Customs Valuation director general and director, Customs Appraisement-East collector, Appraisement-West collector and Port Qasim collector as respondents, the petitioner pleaded the court may set aside/vacate the impugned valuation ruling.

The importer also pleaded the SHC may declare that impugned valuation ruling is illegal, unlawful, mala fide and of no legal effect and restrain the respondents from taking any coercive action against the petitioner.
