IHC dispose of tax reference filed by M/s Nokia Solution and Networks

ISLAMABAD: Justice Miangul Hassan Aurangzeb of Islamabad High Court (IHC) on Friday disposed of a tax reference filed by Nokia Solution and Networks Pakistan (Private) Limited, seeking restrictions for the Federal Board of Revenue (FBR) from recovering Rs 3.643 million.

A single bench of the IHC comprising Justice Miangul Hassan Aurangzeb resumed heard the case and disposed it off with directives to the department to address grievances of the appellants.

Nokia Solution and Networks Pakistan Private Limited had challenged a tax recovery claim amounting to Rs3.643 million issued by field office of Federal Board of Revenue (FBR).

Nokia Solution and Networks Pakistan Private Limited had filed the case seeking restrictions for Large Taxpayers Unit, Islamabad about recovering outstanding tax amount. The company had also sought appropriate relief in account on proceedings started against it by the department.

Federal Board of Revenue (FBR), officers of LTU including Commissioner Inland Revenue, Deputy Commissioner Inland Revenue and Commissioner Inland Revenue (Appeals) were made respondent in the case.

Nokia Solution and Networks Pakistan Private Limited had challenged decision announced by the department’s adjudication. It had prayed the court to set aside the decision announced department’s adjudication.

Nokia Solution and Networks Pakistan Private Limited had submitted that the show cause notice issued to the respondents were lawful and the department must be allowed to proceed on recovering outstanding tax amounts.

Nokia Solution and Networks Pakistan Private Limited argued that the impugned orders were issued under mala fide intentions and had no legal standing or authority. It also stated that due legal course was not followed by the department in issuing the order.
