Appellants, M/s Yarkan International and Nadeem Khan had filed both the cases. Both cases were filed in 2016 and collector customs was made main respondent in the cases. The same bench had held hearing of these cases couple of weeks ago. Then, the bench had conveyed the department to ensure its presence before the bench.  The hearing was adjourned following absence of department’s main counsel from the tribunal.

Both the appellant had challenged decisions of department’s adjudication before the tribunal pertaining to their imported goods which were seized by the authorities following complaints of mis-evaluation.

Both parties had denied the seizure of goods claiming that no mis-evaluation was made while importing the items.
