Collector Dr. Akhtar Hussain issued ONO against M/s Universal Gatway

ISLAMABAD: Collector Customs Adjudication Dr. Akhter Hussain has issued Order- in-Original (ONO) and held M/S Universal Gateway responsible for mis-declaration.

Sources told Customs Today that collector directed M/s Universal Gateway Trading  Corporation, Gilgat to pay Rs. 8.089 million lost in duty and taxes on account of mis-declaration of description and value of 5 consignments of imported fabrics assessed and cleared on 22nd and  23rd July of 2014.

These 5 consignments were assessed and cleared on July 22 and 23, 2014, M/S Universal and proprietor Haji M. Hassan declared the goods as “textile fabrics. The assessing officers assessed the goods as ‘pile knitted stretchable fabrics’ at the value of US$ 2.10/kg, and cleared theses 5 consignments. Customs I&I FBR Rawalpindi objected on the description and valuation of the goods so cleared. Customs I&I had earlier intercepted and seized M/S Universal two consignment of allegedly identical goods. Customs I&I intercepted and seized one more consignment of allegedly identical goods imported, assessed and cleared after five consignments in question.

During laboratory testing, goods contained in these three consignments were found to be ‘printed knitted chenille fabrics’ Customs I&I also referred samples from the above two consignments cleared on 20 June 2014 to Directorate of its valuation Advice to assess the goods at US$ 3.25/kg. Customs I&I charged the M/S Universal with mis-declaration of description and value of the five consignments of imported fabrics.

Collector Customs Adjudication also impose penalty of Rs. 1 million on Ch Ehsanullah Proprietor of M/s New Ehsan Enterprises Customs clearing Agent,  and has said that the Section 29 of the custom Act, 1969 defines the liability of a clearing agent. A clearing agent is liable to pay the revenue lost if the loss is occasioned by his willful act, negligence or default.
