DG Customs Valuation issues Order-in-Revision No 277/2016 against Valuation Ruling No 937/2016

KARACHI: Director General Customs Valuation Syed Tanveer Ahmed has issued Order-in-Revision No. 277/2016 under section 25-D of the Customs Act, 1969 against Valuation Ruling No.937/2016 issued on September 26, 2016. The revision petition was filed by M/s Sheikh Chemical and others.

The petitioner stated that the Valuation Department issued the valuation ruling by enhancing the unit price of the imported item containing liquid chlorinated paraffin from India. In the said valuation ruling the valuation department fixed the value (a) $1/kg.

The petitioner also said: “We have already provided all the documents/data retrieved through Ice gates Zauba confirming that the said item having prevailing prices in international market at $500-550/MT and your kind honor has also accepted the same in the meeting. The previous ruling No: 808 issued by the valuation department in which they fixed the unit price at $0.90/kg which was also on higher side.”

Director General Customs Valuation Syed Tanveer Ahmed in his order said: “I have gone through the record of the case as well as written arguments put forth by the petitioner and the respondent department. Besides, different sources that could provide information about supplier prices have also been explored.”

Director General Customs Valuation also stated that A Majeed Ibrahim Steel Industries Pvt. Ltd, M/s. Sheikh Chemical Co. M/s. Khawaja Enterprises and M/s. N.Y. Trading Co. and others filed review petitions under Section 25-D of the Customs Act, 1969, against the Valuation Ruling No. 937/2016 dated: 29-06-2016.

They are not satisfied with the customs values determined for Liquid Chlorinated Paraffin Wax vide valuation ruling no: 937/2016, this case was fixed on 18-10-2016. M/s. Sheikh Chemicals and Khawaja Enterprises appeared and stated that the value of liquid chlorinated paraffin wax secondary plasticizer as a filler and primary (plasticizer) is on much higher side, added Syed Tanveer Ahmed.

Director General Customs Valuation Syed Tanveer Ahmed, therefore, referred the case to the director to give opportunity of hearing and examine the arguments of importers of the liquid chlorinated paraffin wax based on the chlorine contents.
