KARACHI: The Sindh High Court (SHC) continued the interim order against the impugned show cause notice for recovery of income support levy @ 0.5 percent on the value of net movable assets/ wealth on a constitutional petition filed by Muhammad Usman Abdul Sattar.
A two-member bench, headed by Justice Aqeel Ahmed Abbasi was hearing the petition. During the hearing, Javaid Hashmi advocate presented power of attorney on behalf of the Customs Department and sought time to submit para-wise comments. Therefore, the court granted time and adjourned the hearing for January 11, 2017.
It needs to be mentioned here that on the last date of hearing, the court had suspended the impugned show cause notices issued by the respondents to the petitioner.
Earlier, counsel for the petitioner stated that the petitioner is paying all liabilities regularly, therefore, demand of the income support levy is illegal, without lawful authority and of no legal effect.
Citing Secretary Ministry of Law, Secretary Revenue Division, the Deputy Commissioner Inland Revenue DCIR Unit-1, Zone-V Corporate RTO and the Commissioner Inland Revenue Zone-V as respondents, he pleaded the court may declare that act of the respondents as illegal, mala fide and arbitrary. The counsel further pleaded the court may suspend the impugned show cause notice.
